KOLKATA TRAINEE DOCTOR RAPE AND MURDER CASE: WHY HON'BLE SUPREME COURT OF INDIA HAS TAKEN SUO MOTU COGNIZANCE?

What was the reason that the Apex Court of India intervened in the matter of the Alleged Rape and Murder case of the Trainee Doctor in RG Kar Medical College Hospital Kolkata?

At the Outset, Chief Justice of India DY Chandrachud expressed deep concerns at the fact that the name of the victim, photographs and video clips showing the dead body have been spread all over the media. Further, said this is extremely concerning and ordered to remove and delete all the material related to the present case from all the social media platforms.



Hon’ble CJI said “why we decided to take suo moto though High Court of West Bengal was hearing it because this is not just a case of a horrific murder in the Kolkata Hospital, but this is about systemic issues about safety of doctors across India”

A Bench comprising of Chief Justice of India DY Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra, directed and ordered that National Task Force(NFT) has to give recommendations on the modalities to be followed all over the country to ensure the safety of medical professions. Further, directed NTF to submit an interim report within 3 weeks and a final report within 2 months from the date of the order.

During the hearing of the Suo Motu case on the rape and murder of a doctor at RG Kar Hospital in Kolkata, the Supreme Court on August 20th 2024, questioned the West Bengal government and the Police over the handling of the case. Further, the Hon’ble Supreme Court questioned the west Bengal state over vandalism at hospital and further, Hon’ble Supreme Court asks CISF to provide Security to RG Kar Hospital.

Questions asked by the Hon’ble Supreme Court to Mr. Kapil Sibal, Senior Advocate, appearing on behalf of Sate of West Bengal.

1. What was the principal doing? Why first it was attempted to pass off as suicide? Why the Principal was given the charge of another hospital after he resigned from RG Kar Hospital?

The bench took serious note and said This is very serious issue Mr. Sibal.
